Waiver/Disclaimer - Release of Liability

COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. COVID-19 can lead to severe illness, personal injury, permanent disability and death.

By agreeing to this waiver/disclaimer, I acknowledge the contagious nature of COVID-19, and acknowledge that I am fully aware that myself and/or my child(ren) may be at higher risk of contracting COVID-19 and may be exposed or infected by COVID-19 as a result of entering Full Moon Resort.  Further I acknowledge that becoming infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Resort employees, guests and others present on the Resort property.

With full awareness of the risks involved, I, for myself and on behalf of my children, family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue the Creative Environments LLC DBA Full Moon Resort, its officers, agents, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my children or related in any way to COVID-19 whether caused by the negligence of the Released Parties, any third-party using the Resort, or otherwise.

By agreeing to this waiver/disclaimer I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, claims, actions, damages of any kind arising out of or relating to my or my children’s use of the Resort, its facilities whether caused by the negligence of the Released Parties or otherwise, specifically related to COVID-19.
